Placement of order indicates acceptance of these terms.

Quotes are based on the information you have supplied, electronic file furnished as specified. Final prices may vary if changes or discrepancies occur upon receipt of your written order, including full specifications, copy, layout, and/or samples. All lead times quoted are based on our current press and material availability; actual delivery may vary. All custom orders are subject to a 10% over or under run. All shipments are FOB our factory. Plates, artwork and tooling will be held at the factory for your continued use, and unless written otherwise are the property of Labelsmith, Inc. Any art materials developed by Labelsmith are also the property of Labelsmith.

TERMS: Our terms are net 30 on approved credit. Payment in advance is required if no open account is established prior to placing order. Mastercard, Visa, and American Express are accepted. Invoices not paid on time will automatically put on credit hold any orders in house until payment is received. A finance charge of 1-1/2% per month will be charged on accounts past due. Should it be necessary to place the account for collections, all costs of collection shall be paid by the purchaser.

All labels manufactured by Labelsmith are warranted to be free from defects in material or workmanship. Any product which proves to be defective will be replaced without charge or, at our option, we may issue a credit for the defective products in an amount not to exceed the original invoice amount of the labels. Color match tolerance is within one shade of PMS color, and colors will vary depending upon the label material being printed.

We use high quality materials, inks, stocks, and adhesives. However, we cannot control the manufacture of these products, therefore in no instance shall Labelsmith be held liable for damages arising from the use of the products we manufacture. All products sold by Labelsmith are sold with the understanding that the buyer has independently determined the suitability of such product for the intended application prior to purchase. A stock sample is always available upon request for buyer to test. No warranty is made of any kind, expressed or implied, except that the material quoted shall be of merchantable quality, and the buyer assumes all risk and liability for results obtained by the use of the material. No liability shall result from the delay in performance caused by circumstance beyond the control of Labelsmith, Inc.

No item of any custom order manufactured or in process of manufacture shall be subject to cancellation or change in specification unless consented to by Labelsmith. If cancellation or deferred delivery is agreed to, appropriate charges may be required. No labels may be returned without prior authorization. No claims can be accepted after thirty (30) days from shipment.

Unless there is a clearly written purchase order, the buyer assumes all responsibility for errors, from prepress to delivery of order, and will not hold Labelsmith liable for such errors. If an order does not repeat within two (2) years of the original order, the printing plates may be discarded and all claims for them become null and void. We do not guarantee "no misssing numbers" on consecutively numbered labels orders, unless a guarantee is requested and the additional charge is approved prior to producing the order.
